Attempt to Murder
Bharatiya Nyaya Sanhita, 2023 की धारा 109 हत्या के प्रयास (Attempt to Murder) से संबंधित अपराध को दंडनीय बनाती है। यदि कोई व्यक्ति किसी की हत्या करने के इरादे से ऐसा कृत्य करता है जिससे मृत्यु हो सकती थी, तो यह अपराध BNS Section 109 के अंतर्गत आता है।
🔹 धारा 109 की परिभाषा (Definition)
यदि कोई व्यक्ति किसी अन्य व्यक्ति की हत्या करने के इरादे से ऐसा कार्य करता है, जो यदि सफल हो जाता तो हत्या बनता, तो वह अपराध BNS Section 109 के अंतर्गत दंडनीय होगा, भले ही मृत्यु न हुई हो।
If any person does an act with the intention or knowledge to cause death, and such act would amount to murder if it caused death, he commits the offence of Attempt to Murder under BNS Section 109, even if death does not occur.
🔹 आवश्यक तत्व (Essential Ingredients)
- हत्या करने का स्पष्ट इरादा (Intention to cause death)
- ऐसा कृत्य जो मृत्यु का कारण बन सकता था (Overt act towards commission of murder)
- अपराध और कृत्य के बीच प्रत्यक्ष संबंध (Direct nexus between act and offence)
🔹 सजा (Punishment under BNS 109)
- 10 वर्ष तक का कारावास (Imprisonment up to 10 years)
- या आजीवन कारावास (Or imprisonment for life)
- जुर्माना (Fine)
🔹 अपराध की प्रकृति (Nature of Offence)
- संज्ञेय अपराध (Cognizable offence)
- गैर-जमानती (Non-bailable offence)
- गंभीर आपराधिक अपराध (Serious criminal offence)
🔹 उदाहरण (Example)
यदि किसी व्यक्ति पर जान से मारने की नीयत से गोली चलाई जाए, चाकू से वार किया जाए, या जानलेवा हमला किया जाए, लेकिन वह व्यक्ति बच जाए, तो यह अपराध BNS Section 109 के अंतर्गत आएगा।
For example, firing a gun or stabbing a person with the intention to kill, even if the victim survives, will amount to Attempt to Murder under BNS Section 109.

पहले यह अपराध IPC Section 307 के अंतर्गत आता था, जिसे अब BNS Section 109 द्वारा प्रतिस्थापित किया गया है।
